Terms and Conditions of Sale (TCS)
Preamble
These General Terms and Conditions of Sale (GTC) govern the sale of products by the sole proprietorship Marwa Gattouchi under the trade name "Ma Perle Azur", located at 26 boulevard de la République, 06400 Cannes (SIRET: 10787796100014), to any individual making a purchase via the website maperleazur.fr.
Article 1: Purpose
These conditions define the terms of sale between Ma Perle Azur and the customer, from order to after-sales service, including payment and delivery.
Article 2: Products
The products governed by these GTC are those appearing on the website maperleazur.fr under the brand name Ma Perle Azur (in particular water-resistant jewelry made of 316L stainless steel). The products are described and presented with the greatest possible accuracy. In case of error or omission, Ma Perle Azur cannot be held liable.
Article 3: Price
The prices of our products are indicated in euros, all taxes included (TTC), excluding delivery costs. Ma Perle Azur reserves the right to modify its prices at any time. The product will be invoiced on the basis of the rate in force at the time of order validation. Delivery costs are indicated to the customer before the final validation of their order.
Article 4: Order
The customer validates their order by confirming their cart and accepting these GTC during the payment process. The sale will be considered final after:
- Sending an order confirmation email to the customer;
- Full payment of the price by Ma Perle Azur.
Ma Perle Azur reserves the right to cancel any order in case of dispute with the customer or suspicion of fraud.
Article 5: Payment
Payment is made by credit card or any other secure method offered on the site (Shop Pay, Apple Pay, etc.). Transactions are secured and encrypted by our payment provider Shopify Payments. The customer's bank details are never stored by Ma Perle Azur.
Article 6: Delivery
Products are delivered to the address indicated during the order. Communicated delivery times are indicative. In case of delay, the customer will be informed by email. Ma Perle Azur cannot be held responsible for delays attributable to the carrier or to circumstances beyond its control (bad weather, strike, etc.).
In case of damaged or lost package, the customer must contact Ma Perle Azur within 7 days of the expected delivery date at: maperleazur@gmail.com.
Article 7: Right of withdrawal
In accordance with article L. 221-18 of the Consumer Code, the customer has a period of 14 calendar days from receipt of their order to exercise their right of withdrawal, without having to provide any reason. To exercise it, the customer contacts Ma Perle Azur at: maperleazur@gmail.com. Return costs are the responsibility of the customer.
Article 8: Legal guarantees
All our products benefit from:
- The legal guarantee of conformity (articles L. 217-4 et seq. of the Consumer Code);
- The guarantee against hidden defects (articles 1641 et seq. of the Civil Code).
These guarantees allow the customer to return any defective or non-compliant product for replacement or refund.
Article 9: Intellectual property
All elements of the site maperleazur.fr are and remain the exclusive intellectual property of Ma Perle Azur. Any reproduction, exploitation, or use, even partial, without prior authorization is strictly prohibited and may be subject to legal action.
Article 10: Dispute resolution
These GTC are subject to French law. In case of dispute, an amicable solution will be sought as a priority. Failing this, the competent French courts will be seized.
